If you are a foster provider in the State of Minnesota licensed by the Department of Human Services, approved by a tribal government or the Department of Corrections, you are automatically covered by the group liability policy. The Minnesota Joint Underwriting Association (MJUA) does not know the names of each foster provider, only that if they fit the above definition, they are considered an insured for the policy.
Basically, anything that you are legally obligated to pay as the result of your activities as a foster provider is covered. This includes but is not limited to:
In case you are accused of injuring someone or damaging something because you are a foster provider, we provide attorney's for your defense -- at our cost. Your obligation is to cooperate with them.
The limits of the coverage are $250,000 per incident and the policy will pay up to $500,000 in one year. These limits are for each foster home.
Basic exclusions to the policy include:
If something should happen that you may be liable for for, it is your duty to notify the MJUA. We would rather know about hundreds of incidents that don't turn into lawsuits than to miss one that does. Please follow the procedures of incident reporting from your agency and include the MJUA on your list of people to notify.
Never be reluctant to give anyone the MJUA name or phone number. We would prefer to talk to people before they get the "bureaucratic run around" and address the problem directly.

The Policy or contract is not protected by the Minnesota Life and Health Insurance Guaranty Association or the Minnesota Insurance Guaranty Association. In the case of insolvency, payment of claims is not guaranteed. Only the assets of this insurer will be available to pay your claim. Payment of claims is, however, guaranteed by the enabling legislation which allows that association to assess insurance carriers licensed to do business in Minnesota in the event that the Association is ever in a deficit situation.
